Vendor Terms & Conditions

SNOMOW INC. – INDEPENDENT CONTRACTOR (“SNOMOW CREW”) TERMS & CONDITIONS

For Snow Removal, Yard Care, Landscaping, and Related Services
Effective Date: December 2025

These Independent Contractor Terms and Conditions (“Agreement”) govern all individuals or businesses (“Contractor,” “you,” “your”) who provide services through the Snomow Inc. platform, including the Snomow iOS App, Google Android App, and Website (“Snomow,” “we,” “us,” or “our”).

By creating an account, accepting jobs, or performing services through Snomow, you agree to be legally bound by this Agreement.
1. Independent Contractor Relationship
1.1 You are engaged as an independent contractor, not an employee, agent, partner, joint venturer, or representative of Snomow.
1.2 You are solely responsible for:
Your work methods, tools, and equipment
Meeting Alberta work eligibility requirements
Paying all taxes (income tax, GST, business tax, etc.)
Obtaining required business licenses or permits
Complying with city bylaws and regulations
Obtaining adequate insurance (recommended but not mandatory)
1.3 Nothing in this Agreement creates an employment relationship or entitles you to employee benefits.

2. Eligibility & Registration Requirements
To access the platform, you must:
2.1 Be at least 18 years old or the age of majority in Alberta.
2.2 Provide accurate identification, documents, and information.
2.3 Not submit fake, altered, expired, or misleading documents.
2.4 Understand that any misinformation during signup or while working will result in:
Immediate permanent deactivation
Loss of access to earnings under review
Full responsibility for damages or losses caused

3. Service Standards & Job Performance
3.1 Job Acceptance & Timeliness
Contractor agrees to:
Arrive on time to all scheduled jobs
Complete jobs in the time frame required
Notify Snomow before starting if multiple workers are present so payouts can be calculated accurately
Accept only jobs they are fully capable of completing

3.2 Repeated Cancellations
Frequent cancellations after accepting jobs may result in:
Lower ratings
Reduced job opportunities
Temporary suspension or permanent deactivation

3.3 Failure to Complete Work
If you start a job but fail to complete it:
You may receive no payment
Customer refunds or damage adjustments may be deducted
You may be removed from the platform

4. Safety Requirements
Contractors must use:
Proper equipment suitable for snow removal, yard care, or landscaping
Protective equipment such as gloves, eye protection, ear protection, steel-toe boots, and visibility clothing
Weather-appropriate clothing
Safe work practices compliant with Alberta OHS standards
Failure to follow safety requirements is your own responsibility.

5. Customer Interaction – Zero Tolerance Policy
Contractors are strictly prohibited from:
1. Contacting customers directly
2. Sharing personal phone numbers, email, or social media
3. Asking customers for personal details
4. Accepting cash or direct payments
5. Promoting personal business or handing out business cards
6. Soliciting off-platform work
7. Adding customers on social media or messaging outside the app
Any violation results in immediate and permanent termination.

6. Payments, Tips & Payout Schedule
6.1 Contractors are paid based on the rate displayed and accepted inside the app.
6.2 No contractor may request or accept payment outside the Snomow platform.
6.3 Tips may be provided through the app but are not guaranteed.
6.4 Payouts are typically issued 7–10 business days after job completion (subject to payment processor timelines).
6.5 Payouts may be delayed or withheld for:
Fraud investigations
Missing job photos
Customer disputes
Damage complaints
Non-completion of service
Violation of platform guidelines

7. Property Damage & Contractor Liability
You agree that you are fully responsible for any damage caused by your actions, negligence, or improper use of equipment.
Examples include:
Damaged lawns, sprinkler systems, shrubs, or garden beds
Scratched or damaged vehicles
Broken windows, siding, fences, or garage doors
Sidewalk or driveway damage
Snomow may:
Deduct damage costs from payouts
Remove you from the platform
Pursue legal action for major incidents
Snomow is not liable for your mistakes, negligence, or damage caused during service.

8. Snomow Not Liable – Waiver of Claims
You acknowledge and agree that Snomow is not responsible for:
Injuries you sustain during work
Weather hazards, slips, falls, or ice-related accidents
Vehicle accidents
Equipment failures
Loss of income or wages
Customer behaviour
You further agree that:
You cannot sue Snomow for any damages, injuries, disputes, deactivations, or platform-related issues
Your sole resolution method is internal review through Snomow Support
This clause is a material condition of your access to the platform.

9. Fraud, Misconduct & Platform Abuse
Immediate termination will occur for:
Fraudulent activities
Fake or reused job completion photos
Theft, misconduct, or illegal activity
Harassing or abusive behaviour
Attempting to damage Snomow’s reputation
Posting fake reviews online
Attempting to hack or reverse engineer the app or website
Spreading false information about Snomow
Coercing customers to avoid the platform
Snomow reserves the right to pursue legal and financial actions.

10. Compliance with Laws & Regulations
Contractors must follow all:
Alberta OHS regulations
Calgary snow and noise bylaws
Alberta Consumer Protection laws
Municipal property maintenance rules
Vehicle, insurance, and licensing rules
Provincial and federal tax laws
Failure to comply may result in termination and financial liability.

11. Insurance Requirements
Contractors are strongly encouraged to maintain:
General liability insurance
Vehicle and commercial insurance
Workers’ compensation (if operating a business with employees)
Operating without insurance is at your own risk.

12. Termination by Snomow
Snomow may terminate your account immediately and without notice for:
Fraud or dishonesty
Property damage
Missing or low-quality job results
Repeated cancellations
Fake documents or ID
Off-platform contact or payments
Safety violations
Violation of iOS or Google Play policies
Any breach of this Agreement
Termination is final and not subject to appeal.

13. Platform Removal
Any violation of these terms may result in temporary or permanent removal from the Snomow platform.

14. Ratings & Performance Monitoring
Customers may rate your work after each job.
Consistently low ratings may result in deactivation.
Any attempt to manipulate ratings is considered fraud.

15. Intellectual Property Protection
Contractors may not:
Copy, reproduce, or distribute app materials
Reverse engineer or replicate functionality
Create competing apps using Snomow data
Use or modify Snomow branding without approval
Violations may result in legal action.

16. Dispute Resolution
All disputes must be handled through:
1. Snomow Support
2. Internal review process
3. Final decision issued by Snomow
No external legal action is permitted against Snomow.

17. Governing Law
This Agreement is governed by the laws of the Province of Alberta, Canada.

18. Technology & App Requirements
Contractors must have:
A smartphone with reliable internet
The Snomow app installed and updated
Ability to upload before/after photos
Notifications enabled to receive job alerts

19. Quality & Customer Care Standards
Contractor agrees to:
Deliver high-quality, professional work
Respect property and avoid damage
Communicate politely and professionally
Clean up work areas
Correct minor issues when reasonable

20. Acceptance of Agreement
By signing up, logging in, accepting jobs, or performing any service through Snomow, you confirm that you:
Have read and understood this Agreement
Accept all terms and conditions
Agree not to pursue legal action against Snomow
Agree to maintain professional standards
Agree to comply with all laws and platform rules
